1. Acceptance of Terms

Welcome to Photo Text Editor ("Photo Text Editor", "we", "us"). These Terms of Service ("Terms") govern your access to and use of our AI-powered services, including editing and replacing text in images while matching the original font and layout, available at https://phototexteditor.com (the "Service").

By creating an account, subscribing to a plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years old; (b) have read and agree to these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter this agreement for yourself or for an organization you represent.

If you do not agree to these Terms, do not use the Service. Continued use after an update is acceptance of the revised Terms.

2. The Service

Photo Text Editor provides an AI platform that lets you edit text inside images. The Service is digital software delivered over the internet (SaaS).

The Service is an intangible digital product. Access is turned on when payment is confirmed. Because delivery is immediate, refunds are limited as described in section 7.

The Service uses third-party AI model providers, including OpenAI. Performance and availability can depend on those providers. We will notify users of a material outage.

3. Accounts

You must create an account with accurate information. You are responsible for keeping your login credentials confidential and for all activity under your account.

  • If you notice unauthorized use, email support@phototexteditor.com immediately.
  • Do not share your login credentials.
  • Keep the email address on your account working. We send billing messages there.

If you register for a company or other organization, you confirm that you are allowed to bind that organization.

4. Plans and Credits

We offer subscriptions and separate credit packs.

  • Subscriptions are monthly or yearly. A subscription includes a credit allowance for that billing period. Current plans and prices are on https://phototexteditor.com/pricing.
  • Credit packs are one-time purchases. Credits are used to run editing features.

We may change plan features or add plans. Price changes for an existing subscription follow section 5.

5. Billing and Payment

5.1 Subscription renewal

When you add a payment method and subscribe, you authorize Photo Text Editor to charge that payment method the subscription fee for each billing period. This authorization continues until you cancel under section 6.

Your subscription renews automatically at the end of each billing period unless you cancel. We will email you before a yearly subscription renews.

5.2 Credit packs

Each credit-pack purchase is a one-time charge. By completing checkout you authorize Photo Text Editor to charge the amount shown at checkout.

We do not offer automatic top-up. We will not charge you for more credits unless you start a new purchase.

5.3 Taxes

Prices do not include taxes (including VAT, GST, and sales tax) unless we say otherwise. Where the law requires it, tax is added at checkout and remitted by our payment processor.

Card data is handled only by Waffo Pancake, our PCI-DSS payment processor. We do not store full card numbers.

6. Cancellation

You can cancel a subscription at any time:

Cancellation stops the next renewal. The subscription stays usable until the end of the current billing period. We will not charge later periods. Credit packs you already bought are not cancelled. They keep the validity in section 7.

Account data is kept for 90 days after you close the account, then deleted as described in the Privacy Policy.

7. Credits, Expiry, and Refunds

7.1 Subscription credits

Credits included in a subscription expire at the end of that billing period. Monthly allowances expire after 30 days. Yearly allowances expire after 365 days. They do not roll over.

7.2 Credit packs

Credits in a pack stay valid for 365 days from purchase. Closing or cancelling a subscription does not cancel those credits, and it does not shorten their expiry.

7.3 Order of use

When subscription credits and pack credits are both available, credits with the earliest expiration date are used first.

7.4 Subscription refunds

Subscription fees are generally not refundable after the Service has been delivered, except:

  • First subscription, 7-day window: a first-time subscriber can request a full refund within 7 days of the first charge if usage is not more than 10% of that plan's credit allowance.
  • Duplicate charges caused by a billing error: full refund.
  • A verified outage we caused that lasts more than 72 hours: a prorated refund or an extension of the period.
  • Rights that the law does not allow us to waive, including a 14-day withdrawal right where it applies (for example in the EU or the United Kingdom). Those rights end once you start using the digital Service, where the law allows that.

We do not refund a billing period you have already used, except for the cases above. We do not refund a yearly subscription more than 30 days after the first purchase, except for a duplicate charge, a verified outage, or a right the law requires. We do not refund an account we closed because it broke these Terms.

7.5 Credit-pack refunds

Used credits are not refundable. Exceptions:

  • Unused credits: a full refund of a credit pack if you ask within 7 days of purchase and none of those credits have been used.
  • Duplicate charges: full refund.
  • A 14-day withdrawal right for a first purchase, where the law requires it. That right ends once you use the credits, where the law allows that.

7.6 How to ask for a refund

Email support@phototexteditor.com with your account email, the transaction id, and the reason. We confirm within 2 business days and process an approved refund to the original payment method within 5 to 10 business days.

8. Billing Disputes

If you think a charge is wrong, email support@phototexteditor.com before you dispute it with your bank. We reply within 2 business days and correct a confirmed billing error within 5 business days.

9. AI Output and Intellectual Property

Output generated from your inputs ("Output") belongs to you, as long as you follow these Terms. You may use Output for any lawful purpose allowed by section 10.

You grant Photo Text Editor a limited, non-exclusive license to use content you submit ("Input") only to provide the Service to you. We do not use your Input to train AI models without your explicit consent.

The Service uses third-party AI models, including models from OpenAI. Output can reflect those models. We do not guarantee a particular output quality, and we are not responsible for content those models produce.

AI output can be wrong or incomplete. You are responsible for reviewing it before you rely on it. Do not treat it as professional, legal, medical, or financial advice.

The Service itself, and our own software, branding, and site content, belong to us and are protected by intellectual-property laws.

10. Acceptable Use

Use the Service only for lawful purposes that follow these Terms.

You agree not to use the Service to:

  • Generate illegal, defamatory, harassing, or fraudulent content.
  • Generate or help create deepfakes, including AI audio, video, or images that imitate a real person or mislead someone about the source.
  • Generate sexual content involving minors, or any content that breaks child-protection laws.
  • Create malware, phishing content, or attack tools.
  • Infringe someone else's intellectual property or privacy.
  • Bypass or interfere with security features.
  • Resell or sublicense access without our written permission.
  • Break applicable law or card-network rules.
  • Request, generate, upload, or share sexual, adult, NSFW, or pornographic content, including nudity or sexually explicit material.
  • Request or create face-swap or other face or identity manipulation intended to deceive, impersonate, or harass.

You also agree not to:

  • Use Input, Output, or model responses to train, fine-tune, benchmark, or distill a competing AI or machine-learning model.
  • Scrape or collect Output at scale for any purpose other than your own authorized use.
  • Present AI output as the work of a licensed professional, such as a doctor, lawyer, or financial adviser, where that could cause harm.

11. Privacy and Security

Your use of the Service is covered by our Privacy Policy at https://phototexteditor.com/privacy-policy. Card data is processed only by Waffo Pancake and is not stored on our servers. Account data is kept for 90 days after cancellation, then deleted.

12. Disclaimers and Liability

The Service is provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, or accuracy of AI output.

AI output may be inaccurate, incomplete, or out of date. Do not use it as legal, medical, financial, or other professional advice. Check it before you act on it.

To the maximum extent the law allows, Photo Text Editor is not liable for indirect, incidental, consequential, or punitive damages. Our total liability for a claim is limited to the amount you paid us in the 12 months before the claim.

13. Term and Ending Access

These Terms last while you use the Service. We may suspend or close an account for a serious breach, suspected fraud, or a legal requirement. If we end the Service for a reason that is not your breach, we will refund the unused prepaid portion on a prorated basis. You can ask us to delete your account by emailing support@phototexteditor.com.

14. Law and Disputes

Please email support@phototexteditor.com and try to resolve a dispute informally before you start a formal proceeding. These Terms are governed by the laws that apply to the operator of the Service.

15. Changes

We may update these Terms. For a material change we will email you at least 14 days before it takes effect. Continuing to use the Service after that date is acceptance. If one clause is invalid, the rest stay in effect. These Terms and the Privacy Policy are the whole agreement between you and Photo Text Editor.
